At Kira Learning, Inc. ('the company', 'we', or 'us'), we respect your privacy and are committed to protecting it as described in this privacy policy ('Policy' or the 'Privacy Policy'). This policy describes the types of information we may collect from users or that users may provide when they use our product, Kira Learning ('the product', 'the service', 'the website', 'the app', or 'product') and our practices for collecting, using, maintaining, protecting, and disclosing that information. Your use of the Kira Learning Product and any information you provide on the Service are subject to the terms of this Privacy Policy, which is incorporated into and subject to our Terms of Service.
Personal information we collect
The categories of personal information we collect depend on how you interact with us, our Services and the requirements of applicable law. We collect information that you provide to us, information we obtain automatically when you use our Services, and information from other sources such as third-party services and organizations, as described below.
A. Information you provide to us directly
We may collect the following personal information that you provide to us. Please see our COPPA Privacy Notice for more information about our collection of information about children under sixteen.
Account Information: We may collect personal information in connection with the creation and administration of your account such as your name, email address, phone number, non-public information including educational records or details, and details about your employer.
Child Registration: Children may provide personal information about their Responsible Parent for the purpose of helping the Responsible Parent provide their consent for the Child’s use of the Services. This may include, but is not limited to, the Responsible Parent’s name and email address.
Your Communications with Us: We may collect personal information, such as email address, phone number, or mailing address when you request information about Kira Learning or the Services, or otherwise communicate with us.
Interactive Features: We may collect personal information that you submit or make available through our interactive features (e.g., video conferencing feature, contact functionalities, social media pages, etc.). Please note that to use our video conferencing feature, you will need to provide Kira with access to your device’s microphone and/or camera and consent to our making a video and audio recording of you. Any recordings of video conferencing meetings we collect will not be made generally available to the “public” unless we have provided you with notice of this practice and obtained your consent. Any personal information you provide on any public sections of these features will be considered “public,” unless otherwise required by applicable law, and is not subject to the privacy protections referenced herein.
Surveys: We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information which may include personal information.
B. Information collected automatically
We may collect personal information automatically when you use our Services:
- Automatic Data Collection: We may collect certain information automatically when you use our Services, such as your Internet protocol (IP) address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, browser or device information, location information (including approximate location derived from IP address), and Internet service provider. We may also automatically collect information regarding your use of our Services, such as analytics about your use of the Services, personal information contained in any content you generate using our Services, details about your software coding efforts and capabilities, your coursework progress, information about the links you click, the types of content you interact with, the frequency and duration of your activities, and other information about how you use our Services.
- Cookies, Pixel Tags/Web Beacons, and Other Technologies: We, as well as third parties that provide content or other functionality on our Services, may use cookies, pixel tags, local storage, and other technologies (“Technologies”) to automatically collect information through your use of our Services. Please note, we do not use any third-party cookies within product for personalized advertising or to track users and display personalized advertisements on other third-party websites or services.
Our uses of these Technologies fall into the following general categories:
- Operationally Necessary: This includes Technologies that allow you access to our Services, applications, and tools that are required to identify irregular website behavior, prevent fraudulent activity and improve security or that allow you to make use of our functionality;
- Performance-Related: We may use Technologies to assess the performance of our Services, including as part of our analytic practices to help us understand how individuals use our Services (see Analytics below);
- Functionality-Related: We may use Technologies that allow us to offer you enhanced functionality when accessing or using our Services. This may include identifying you when you sign into our Services or keeping track of your specified preferences, interests, or past items viewed;

How we use your personal information
We limit the data we process and collect from users of the Kira learning product to only what is required to deliver the services. Our Service is free from any advertising including any contextual or personalized advertising. We use personal information from users for the following purposes:
Service delivery (such as provide, operate and improve the service and our business, review, screen and monitor user created content)
Security and research
Customer service and communicating with you
Compliance with applicable laws
How we share your information
As part of providing our services, we may share data with third party vendors who process information to help us provide our services. You can view the vendors we use to process data and the purposes for which they are used to provide our product below.
Amazon Web Services (AWS): Infrastructure provisioning, cloud computing, and data storage.
Google Cloud Platform (GCP): Infrastructure provisioning, data analytics, and cloud hosting services.
Amplitude: Website analytics, tracking user interactions, and platform optimization.
HubSpot: CRM services, sales pipeline management, and direct marketing automation.
Sentry: Error tracking, application monitoring, and software performance management.
Please note that we establish contractual limits with third-party vendors regarding the extent and purposes for which they can use personal information that we may disclose to them.
For the avoidance of doubt, within the Kira learning product we do not share data with third parties for their own marketing, advertising purposes, or creating advertising profiles. Additionally, we do not sell or rent personal data to third parties.
We may disclose information, including personal information, if we have a good faith belief that doing so is necessary to comply with the law, such as complying with a subpoena or other legal process.
In the event of a merger, acquisition, or bankruptcy, user information may be transferred to an acquiring third party as permitted by law.
Other sites and services
The Service may contain links to websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or other online services that are not associated with us. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen or approve, and are not responsible for, the privacy practices or content of such other websites or applications
Cookies
Our Product may use cookies or similar technologies to help you personalize your online experience. A cookie is a text file that is placed on your device browser that stores preferences to facilitate and enhance your experience. For example, if you register with our Product or Services, a cookie helps our Product to recall your specific information on subsequent visits. To prevent unauthorized access, disclosure, or improper use of your information we’ve established safeguards to limit access to user information. Additionally, user data is encrypted in storage and transit.
We strive to protect personal data and secure our systems, but no system is entirely secure, and we cannot guarantee absolute security. In the event that we learn of a security breach, we will attempt to notify you.
Your Privacy Rights
Except as otherwise provided, this section applies to residents of states where they have privacy laws applicable to us that grant their residents the rights described below.
For purposes of this section, “personal information” has the meaning given to “personal data”, “personal information” or similar terms under the applicable privacy laws of the state in which you reside. Please note that not all rights listed below may be afforded to all users and that if you are not a resident of the relevant states, you may not be able to exercise these rights. In addition, we may not be able to process your request if you do not provide us with sufficient detail to allow us to confirm your identity or understand and respond to it.
In some cases, we may provide a different privacy notice to certain categories of residents of these states, such as job applicants, in which case that notice will apply with respect to the activities it describes instead of this section.
Verification: Upon receipt of your request, we will initiate the identity verification process to confirm that you are the individual for whom we hold information in our system. This verification procedure necessitates your cooperation in supplying relevant information, allowing us to compare it with the details you previously furnished. Depending on the nature of your request, we may request specific information to align with our existing records, or we may reach out to you using a previously provided communication method (such as phone or email). In certain situations, alternative verification methods may be employed based on the circumstances.
Any personal information disclosed in your request will solely be utilized for the purpose of confirming your identity or validating your authority to make the request. We will make every effort to minimize the need for additional information for verification purposes. However, should it be impossible to verify your identity with the existing information in our records, we may request additional details to ensure the security and prevent fraud. Any supplementary information you provide for verification will be promptly deleted upon the completion of the verification process.
Authorized Agents: Your authorized agent may be able to make a request on your behalf. However, we may need to verify your authorized agent’s identity and authority to act on your behalf. We may require a copy of a valid power of attorney given to your authorized agent pursuant to applicable law. If you have not provided your agent with such a power of attorney, we may ask you to take additional steps permitted by law to verify that your request is authorized, such as by providing your agent with written and signed permission to exercise your rights on your behalf, the information we request to verify your identity, and confirmation that you have given the authorized agent permission to submit the request.
Correction: You can request that we correct inaccurate personal information that we have collected about you.
Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that while we do not respond to or honor Do Not Track (DNT) signals or similar mechanisms transmitted by web browsers, we do not use cookies or similar technologies to track users for advertising purposes.
FERPA Statement
The privacy of students’ information is important to us. Our collection and use of personal information and educational records are governed by our contracts with schools, our Privacy Notice including our COPPA Privacy Notice (applicable to data of children under 13), and by applicable privacy laws including the Family Educational Rights and Privacy Act (FERPA). We seek to protect personal information and records of students as required by FERPA.
Our hosting providers, including Amazon Web Services (provided by Amazon.com, Inc.) will hold all data processed by our platform on their servers, and make the platform available to students, teachers and to us for use. The personal information (as defined pursuant to FERPA) that we hold includes each student’s first and last name, IP address from which they access the Services, their email address, their age or school year, the name of their school, their software development skill level, and audio and video files containing their voice, image and likeness.
Our analytics services providers, including Google Analytics provided by Google LLC, automatically collect information from our students, including children, when they access and navigate through our services and use certain of their features. The information we and our service providers may collect through these technologies includes:
- Information about the student’s interactions with our Services, including: the languages they choose; pages they visit; when they approach the bottom of each page; when our webpages are in focus on their device; what webpages they come from and head to; their screen resolution; when they access files; the first time they interact with a form; when they submit a form; their search results; and the start time, end time, and progress of any videos they may watch.
- Information about your child as a user of our Services, including: the city, country, continent, subcontinent, region, browser, and IP address from which user activity originated, and the operating system and platform that they use to visit our Services.
If you are a parent of a child under 18 or an eligible student over the age of 18, you have certain rights with respect to the information we and schools process about students, including the rights to access, inspect and review educational records; challenge and correct their contents; prevent their disclosure without prior written consent (unless we are authorized by law to make such disclosures without consent); and request copies of records we have disclosed.

Children's Privacy
Protecting children’s privacy online is very important to us. The product is intended for general use but may be used by children. We take care to obtain verifiable parental consent before collecting information about children under sixteen years of age. Please reference our COPPA Statement for more information.
Changes To This Privacy Policy
We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you as required by applicable law and we will update the date of this Privacy Policy and post it on the Services or other appropriate means. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your use of the Services after the effective date of any modified Privacy Policy indicates your acknowledgment that the modified Privacy Policy applies to your interactions with the Services and our business.
Kira Learning Artificial Intelligence (AI) Use Policy

Kira Learning (“Kira”) is committed to providing advanced educational tools that enhance the learning experience for students and teachers. As part of our Services, we utilize artificial intelligence (AI) technologies to assist in various educational activities. This AI Use Policy outlines the specific terms and conditions related to the use of AI within our Services.
AI Tutor Feature
Kira Learning’s AI Tutor is designed to help students and teachers understand course concepts and work through activities and problems. The AI Tutor offers personalized support by providing explanations, answering questions, and guiding users through the learning process. The AI Tutor uses anonymized data to deliver tailored educational assistance, ensuring that privacy is maintained at all times.
AI-Assisted Grading
Kira Learning’s AI technology also assists teachers by making grading recommendations for exercises and activities submitted by students. These recommendations are intended to support teachers in their grading process by providing insights based on predefined criteria and patterns recognized by the AI. Teachers retain full control over the final grades and can accept, modify, or disregard the AI’s suggestions.
Opt-Out Options
Kira Learning understands that the use of AI may not be suitable for all users. Therefore, we offer the ability for teachers, schools, or districts to opt out of using AI features for individual students, entire sections, or broader educational entities. To opt out of AI features, please email support@kira-learning.com with your request, specifying the scope of the opt-out (e.g., student, section, school, or district). Our support team will process your request promptly.
Data Privacy and Security
Kira Learning values the privacy and security of our users’ data. When using AI features within our Services, any data sent to our AI provider, OpenAI, is fully anonymized to protect user identities. Additionally, we do not permit OpenAI to use any data processed through our platform to train or improve its models. Your educational data remains confidential.

By using the AI features within Kira Learning, you acknowledge and agree to the following:
The AI Tutor and AI-Assisted Grading features are tools designed to support, not replace, the role of teachers.
Kira Learning does not guarantee the accuracy or completeness of the AI-generated content or recommendations.
You are responsible for overseeing the AI’s contributions and ensuring that they align with your educational objectives.
Changes to AI Use Policy
Kira Learning may update this AI Use Policy from time to time to reflect changes in technology, regulatory requirements, or our Services. We will notify users of any significant changes by posting the updated policy on our Site, within the application, or through other communication channels. Continued use of the Services after such changes have been posted constitutes your acceptance of the revised policy.
This policy is designed to clarify the role of AI in Kira Learning’s products, ensure transparency around data use, and provide options for those who may choose not to utilize AI features.
